Are Disposable Vapes Banned in the UK? What the Law Says
Yes, single-use vapes have been banned from sale across the UK since 1 June 2025. What the law covers, what still counts as legal and how it's enforced.
Vaping is legal in the UK for adults, but buying and selling vapes is tightly regulated. You must be 18 or over to buy them. Nicotine e-liquid is capped at 20mg/ml and sold in bottles of 10ml or less, and tanks and pods hold no more than 2ml. Single-use vapes have been banned from sale since 1 June 2025. Vaping liquid is taxed from 1 October 2026. The Tobacco and Vapes Act 2026 adds rules on free samples and displays, with an advertising ban planned for 2027.
| Rule | What it means | Where it comes from |
|---|---|---|
| Age of sale | 18 or over for vapes and nicotine products | Tobacco and Vapes Act 2026 and earlier regulations |
| Product limits | 20mg/ml nicotine, 10ml bottles, 2ml tanks and pods | TRPR 2016, regulation 36 |
| Disposable ban | No sale of single-use vapes since 1 June 2025 | Single-use vapes regulations in each nation |
| Vape tax | £2.20 per 10ml of vaping liquid from 1 October 2026 | Vaping Products Duty (HMRC) |
| Promotion | Free samples and big discounts banned; ads to follow | Tobacco and Vapes Act 2026 |
| Recycling | Vape sellers must take old vapes back | GOV.UK guidance and WEEE rules |
| Flying | Hand luggage only, no vaping or charging on board | CAA rules and airlines |
The disposable vape ban is the change most people have noticed. A vape sold in the UK must now have a rechargeable battery, a refillable or replaceable pod or tank, and a replaceable coil. That ban covers nicotine-free vapes too.
The 20mg/ml, 10ml and 2ml limits are older, from the Tobacco and Related Products Regulations 2016. They're why big shortfill bottles are nicotine-free.
From 1 October 2026, vaping liquid carries a duty of £2.20 per 10ml, whether it contains nicotine or not. Products also need duty stamps, and by 1 April 2027 everything on sale must carry one. Our vape tax guide has the dates, the arithmetic and the travel allowance.
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. For vapes, its sale and distribution rules came into force on 29 October 2026, including a ban on free samples and big promotional discounts. The government intends the advertising and sponsorship ban to start on 1 June 2027. The Act also lets ministers regulate flavours, packaging, displays and vape-free places, but each of those needs regulations first. Its generational ban on tobacco sales, for anyone born on or after 1 January 2009, starts on 1 January 2027 and doesn't apply to vapes.
UK smoke-free law covers smoking, not vaping, so there's no general ban on vaping indoors. Pubs, workplaces, trains and venues set their own policies, and many ban it inside. Planes are a firm no. Our guide on taking a vape on a plane covers the CAA rules: vapes in hand luggage only, no vaping and no charging on board.
Vapes are electrical waste and must never go in household bins, because the lithium batteries can start fires. Shops that sell vapes have to take old ones back. Our how to recycle vapes guide lists every drop-off option.
For shoppers, it comes down to buying reusable kits and stamped products from legitimate UK sellers, and recycling properly. Our vape kits hub explains the legal device options and the e-liquid hub covers strengths.

There's no general UK law against vaping indoors. Venues, employers and transport operators set their own rules. The Tobacco and Vapes Act 2026 gives governments powers to create vape-free places, but none have been created yet.
Yes, for adults. The UK regulates what can be sold, who it can be sold to and how it's promoted, but vaping itself is legal.
